Berita7 | Mancanegara, Tangerang, Indonesia,.– A plot of public land in Pondok Bahar, Karang Tengah District, Tangerang City, Indonesia, has been officially returned to the local community after being used without authorization for private purposes.

The 85-square-meter parcel, designated as fasilitas sosial dan fasilitas umum (social and public facilities or fasos fasum), had been occupied by a resident who built a semi-permanent structure on it. According to Indonesian spatial planning laws, such land is intended solely for public benefit — including green spaces, playgrounds, or community access roads.

Following a community meeting and legal clarification, the land user—represented by  voluntarily relinquished the land on Thursday, July 31, 2025, in front of local officials and community leaders.

“We thank everyone who contributed to resolving this matter peacefully,” said H. Shaleh La Ella, SH., MH., community advisor of RT 001/05. “This land must remain accessible and beneficial for the people. We urge local governments to regularly inventory public land to prevent future misuse.”

The issue received support from Mochamad Pandu, SE, a local member of the Tangerang City Council, who helped mediate between the land user and community.

Under Article 69 of Law No. 26/2007*on Spatial Planning, unauthorized use of land that results in a change of designated function can result in up to 3 years of imprisonment or a fine of IDR 500 million (approx. USD 30,000). Furthermore, Law No. 23/2014 on Regional Government outlines developers’ responsibility to allocate and protect fasos fasum areas.

A formal letter from the Head of Pondok Bahar Urban Village (Letter No. 640/85-Ekbang/2025) and a previous agreement (Document No. 646/2509-Perkim/2018) confirmed the land’s status as fasos fasum. According to the agreement, any unauthorized structures on the land would be removed without compensation.

The peaceful resolution of this case is seen as a positive precedent, reinforcing the importance of protecting public land from unauthorized private use. (Jk)
